ELMLY TERMS OF SERVICE
Effective date: 20 September 2026
These terms set out the rules for using Elmly and what you and we can expect from each other. Please read them together with our Privacy Policy.
1. ABOUT THESE TERMS
These terms are an agreement between you and Elmly. They cover the Elmly mobile app, our websites and related services. Where these terms say "we", they mean Elmly.
By creating an account or using Elmly, you accept these terms. If you do not accept them, please do not use Elmly.
When Elmly asks you to confirm that you accept these terms and our Privacy Policy, for example when you sign up or after a new version is published, we keep a record of which versions you accepted and when. Our Privacy Policy describes that record.
Our Privacy Policy explains what personal data we collect, why, and who processes it on our behalf. It is a separate document, and nothing in these terms reduces the rights it gives you.
2. WHO CAN USE ELMLY
Elmly is intended for students aged 13 and over, and for teachers. You may not use Elmly if you are under 13.
If you are under 18, you may use Elmly with the agreement of a parent or guardian, who should read these terms and our Privacy Policy with you.
You must be 18 or older to teach on Elmly. By creating a teacher account, you confirm that you are.
Elmly has two kinds of account: student and teacher.
3. YOUR ACCOUNT
Give accurate information when you create your account, and keep it up to date.
Keep your password to yourself. Do not share, sell or hand over your account, and do not use anyone else's.
You are responsible for what is done through your account, unless someone got into it without any fault of yours. If you think someone else has access to your account, change your password and write to us at support@elmly.app.
4. WHAT ELMLY PROVIDES
Elmly is an exam preparation service for students preparing for university entrance examinations in Azerbaijan. It includes:
• topic practice and quizzes;
• mock exams;
• Competitive Mode, which gives you AI-generated questions that can focus on topics you choose or on your weak topics;
• exams created by teachers;
• analytics, a predicted exam score, a study plan and goals;
• a leaderboard;
• a teachers section, where students can find a teacher, send a lesson request and, once the teacher accepts it, message the teacher.
We may add, change or remove features. If we remove a feature that is central to how you use Elmly, we will tell you in advance where we reasonably can.
5. EXAMS, SCORES AND THE LEADERBOARD
Official Elmly exams are the mock exams that Elmly has marked as official. Other mock exams, and exams created by teachers, are not official Elmly exams.
Your exam score is calculated by Elmly from the answers you submit.
Mock exam results, analytics and the predicted exam score are there to help you prepare. The predicted score is an estimate. None of them is the result of a state examination, and none of them guarantees a particular score in the real exam or admission to a university.
Your leaderboard points are updated when you complete an official Elmly exam. They are calculated mainly from your recent official exam results, and they also take into account your practice accuracy over the last 30 days and your study streak. Practice, quizzes, Competitive Mode, other mock exams and exams created by teachers do not change your points on their own. We may change how points are calculated, and we may reset the leaderboard.
If you are a student, you appear on the leaderboard unless you turn this off in the app's Settings.
We may correct or remove results and points obtained by cheating, by breaking these terms or through an error.
6. AI FEATURES
Some features of Elmly use a third-party artificial intelligence (AI) service: explanations of questions and answers, study insights, the questions in Competitive Mode, and the grading of written exam answers.
AI can make mistakes. An explanation can be wrong, a generated question can be flawed or have the wrong answer, and a grade can be too high or too low. Treat what the AI gives you as help with your studies: it does not replace a teacher, your textbooks or official exam materials.
The grade the AI gives a written answer counts toward your exam result and, in an official Elmly exam, toward your leaderboard points. If you think a grade or an explanation is wrong, write to us at support@elmly.app.
AI features may have usage limits, and we may change, pause or switch them off.
What we send to the AI service, and what we do not send, is explained in our Privacy Policy.
7. TEACHERS AND LESSONS
How lessons work. A student can ask a teacher for a lesson, online or, if the student and the teacher are in the same city, in person. Each lesson is requested separately through Elmly. The teacher accepts or declines the request. While a request is waiting for the teacher, the student can cancel it in the app. After a lesson, the teacher marks it as completed.
Elmly's role. Elmly provides the list of teachers and the means to send lesson requests and messages. Elmly does not give lessons and is not a party to the arrangement between a student and a teacher. Teachers on Elmly are independent: nothing in these terms makes a teacher an employee, agent or partner of Elmly. Elmly does not provide video calls: for an online lesson, the student and the teacher agree in their Elmly messages how it will be held.
Elmly does not set rules on cancelling, rescheduling or missing a lesson. Once a teacher has accepted a request, any change is agreed between the student and the teacher.
The verified mark. Some teachers have a verified mark on their profile. It does not guarantee a teacher's identity, qualifications, suitability to teach children or the quality of their teaching, and a teacher does not need it to appear on Elmly or to receive lesson requests.
Staying safe at in-person lessons. Elmly does not supervise, vet or attend lessons. Meet in a public place, and tell a parent or guardian, or another adult you trust, when and where the lesson will be. If you are under 18, go to an in-person lesson only with the knowledge of your parent or guardian.
If you teach on Elmly, you must be 18 or older; describe your qualifications, experience and subjects truthfully; give the lessons you accept, or tell the student in good time if you cannot; behave professionally with every student, remembering that students may be under 18; and comply with the laws that apply to your teaching, including tax law.
If you are a student, give accurate details in your request and tell the teacher in good time if you cannot attend. If you are under 18, tell your parent or guardian before you send a lesson request.
Reviews must be honest and based on your own lessons with that teacher.
If a problem with a lesson cannot be resolved between you, write to us at support@elmly.app. Because Elmly is not a party to the lesson arrangement, we cannot promise a particular outcome, but we can take action under these terms, including limiting or closing an account. If anyone's safety is at risk, contact the police first.
8. KEEPING LESSONS AND PAYMENTS IN ELMLY
Elmly is where students and teachers find each other. Lessons with a student or teacher you met through Elmly are arranged through Elmly, and any payment for them is made only through Elmly. In particular, you must not:
• pay a teacher, or accept payment from a student, outside Elmly, for a lesson booked through Elmly or for any lesson with a student or teacher you met through Elmly;
• share, ask for or offer contact details, such as a phone number, email address, social media or messenger account or website link, in order to arrange lessons or payment outside Elmly;
• put such contact details in your bio or anywhere else on your profile that other users can see, in a review, or in the notes of a lesson request.
Using what Elmly gives you for a lesson booked through Elmly does not break this section. That covers the phone number you save in the Phone field of your profile, which Elmly shows to the other person once a lesson request between you is accepted; the address you give for an in-person lesson; and what you share in your Elmly messages to hold the lesson, such as the link to an online lesson. Using any of these to arrange lessons or payment outside Elmly does break this section.
Breaking this section may lead to your account being suspended or permanently closed. What we do will depend on how serious the breach is and whether it has happened before. If someone asks you to pay, or to arrange lessons, outside Elmly, please tell us at support@elmly.app.
9. PAYMENTS
Lessons booked through Elmly are currently free. Sending a lesson request is free, and no one may charge for a free lesson, in Elmly or outside it.
If Elmly offers paid lessons, subscriptions or other paid features in the future, their price and terms will be shown in Elmly before you book or buy, you will be charged only if you confirm, and payment will be made only through Elmly. Before we start taking payments, we will update these terms and our Privacy Policy and tell you.
A rate shown on a teacher's profile does not make a lesson paid: what a lesson costs, if anything, is what Elmly shows you before you book it.
10. RULES OF CONDUCT
Do not use Elmly to:
• break the law, or help anyone else break it;
• harass, threaten, bully, insult or discriminate against anyone;
• post sexual, violent or hateful content, or any content that sexually exploits or endangers children;
• pretend to be someone else, or give false information about yourself or your qualifications;
• post content you have no right to share, or anyone's personal information without their permission;
• send spam or advertising;
• cheat or manipulate exam results, the leaderboard or reviews, including by using more than one account or by sharing answers to official exams;
• copy questions, exams or explanations out of Elmly in bulk, republish them or sell them;
• use bots, scrapers or other automated tools on Elmly, or get around usage limits;
• try to get into accounts or data that are not yours, test or break Elmly's security, or interfere with how Elmly works;
• break the rules in section 8.
11. YOUR CONTENT
Your content is what you create or upload on Elmly: your answers, your messages and their attachments, your reviews, your profile details and photo and, if you teach, the exams and questions you write. It remains yours.
You give Elmly a non-exclusive, royalty-free permission to store, copy, display and process your content, only as far as needed to provide Elmly: for example, to show your profile and reviews to other users, to deliver your messages, to show a teacher's exam to students, and to send your written answers to the AI service for grading and explanations. This permission ends when the content is deleted from Elmly, except for copies kept as our Privacy Policy describes.
Your name, profile photo, bio and city can be seen by other signed-in users. If you teach, your teaching profile (bio, city, subjects, education, experience and rates) can be seen by anyone, including people who are not signed in; your availability can be seen by signed-in users, and your certificates only by you and our staff. Reviews can be read by anyone, including people who are not signed in.
You are responsible for your content, and you confirm that you have the right to post it. We may remove content, or limit who can see it, if it breaks these terms or the law.
12. ELMLY'S CONTENT
The Elmly app and websites, their software and design, and the Elmly name and logo belong to Elmly. The questions, explanations, mock exams and other learning materials on Elmly are for your own studying or teaching on Elmly. You may not copy them out of Elmly in bulk, republish them, sell them or use them to build another service.
Using Elmly does not make you the owner of any of this. Exams and questions written by teachers are their content, and section 11 applies to them.
13. DELETING YOUR ACCOUNT
You can delete your account at any time in the Elmly app, under Settings, then Account Management, or on the account deletion page of our website. You do not need to contact us or give a reason.
Deletion is permanent: your progress, results and place on the leaderboard cannot be restored afterwards. What happens to your personal data after deletion is explained in our Privacy Policy.
If you have lessons arranged with someone, let them know before you delete your account.
14. SUSPENSION AND CLOSURE
You can stop using Elmly at any time.
We may limit, suspend or permanently close an account if its owner seriously or repeatedly breaks these terms, including section 8; if that is needed to protect other users, Elmly or anyone else; or if the law requires it. What we do will be proportionate to what happened.
Where we can, we will tell you what we have done and why. If you think we have made a mistake, write to us at support@elmly.app. We may act without notice where notice would put someone at risk, would let harm continue, or is not allowed by law.
If your account is closed for breaking these terms, do not create a new account without our permission.
15. DISCLAIMERS
We work to keep Elmly accurate and available, but we cannot promise that it will always be available or free of errors, or that every question, answer key, explanation or grade is correct. If you find a mistake in a question, report it with the flag next to the question in the app (Report a Problem) or write to us.
Elmly helps you prepare. It does not promise any score in any examination or admission to any university.
Except as these terms say otherwise, Elmly is provided as it is, to the extent the law allows. This does not affect any rights the law gives you that cannot be excluded.
16. LIMITATION OF LIABILITY
To the extent the law allows, Elmly is not liable for:
• loss that could not reasonably have been foreseen;
• indirect loss, such as a missed opportunity, including one connected with an examination result or university admission;
• what happens in a lesson, any arrangement between a student and a teacher, or any payment made outside Elmly, since Elmly is not a party to them;
• content posted by other users;
• delays or failures caused by events outside our reasonable control, such as internet outages or failures at our service providers.
Nothing in these terms limits or excludes any liability that cannot be limited or excluded by law, including liability for harm caused intentionally or through gross negligence.
17. CHANGES TO THESE TERMS
If we change these terms, we will publish the new version here with its effective date. If a change is significant, we will also tell you in the app before it takes effect, unless it has to take effect sooner because the law requires it or to keep users safe. Continuing to use Elmly after a new version takes effect means you accept it. If you do not accept it, you can stop using Elmly and delete your account.
18. GOVERNING LAW AND DISPUTES
These terms are governed by the law of the Republic of Azerbaijan. If you have a complaint, please write to us first so that we can try to resolve it. If we cannot, the dispute will be decided by the competent courts of the Republic of Azerbaijan. This does not take away any protection that the law of the country where you live gives you and that cannot be excluded by agreement.
If a court finds any part of these terms invalid, the rest still applies. If we do not enforce a term straight away, we can still enforce it later.
